Terms of Service

These terms of service (as of 2026) regulate the relationship between the operator of test-web (hereinafter referred to as "Operator") and the users (hereinafter referred to as "Players") of the website blockbay.etherealmc.de as well as the Minecraft server play.blockbay.fun. The terms also cover user accounts, staff applications, the player report system, uploaded evidence, and data processing associated with these services.
§ 1 Scope
These terms of service apply to all offerings of the operator, in particular for the use of the Minecraft server, the website and the associated community platforms. By connecting to the server or using the website, players agree to these terms.
§ 2 No Contractual Claim, Free Service
test-web is operated as a free, private hobby project. There is no claim to use of the server, availability, retention of in-game progress, items, ranks or purchased benefits. The operator can terminate, change or restrict the service at any time entirely or partially.
§ 3 Server Rules
On the server, the following are particularly prohibited:
- Using cheats, hacks, autoclickers, X-Ray or other unauthorized modifications
- Exploiting bugs or exploits
- Insults, discrimination, hate speech, sexual harassment as well as the dissemination of criminal content
- Advertising for other servers, selling accounts or items for real money outside the official store
- Account-sharing and circumvention of sanctions (ban-evading)
- Griefing outside the approved PvP zones and lifesteal mechanics
- Submitting false or abusive player reports, uploading inappropriate or manipulated evidence, or attempting to use the report system to harass other players
Violations may be punished with a warning, a temporary or permanent ban, or a refusal to issue a refund. The staff team will determine the penalty at its discretion.
§ 4 Player Reports and Evidence
The report system allows players to report rule violations. A report is only valid once the reporter has verified their Minecraft username in-game using /verifyreport <code>. The operator may correct the reported username to the verified in-game name and document any mismatch.
Uploaded evidence must relate to the reported incident. Acceptable file types are PNG, JPG, GIF, WEBP, MP4, WEBM and MOV, with a maximum size of 25 MB per file. Evidence is stored securely and is only accessible to authorized administrators. By uploading evidence, the user confirms that they have the right to share the file and that it does not violate applicable law or the rights of third parties.
§ 5 Player Behavior
Players are obligated to behave respectfully towards other players and the staff team. Instructions from the staff team must be followed. For all actions taken via the account, the account holder is responsible.
§ 6 Community Moderation and Youth Media Protection (JMStV)
The server chat and community platforms are moderated to prevent insults, discrimination, hate speech, harassment, and the distribution of illegal content. The operator and designated staff may warn, mute, kick, or ban users who violate the rules. Chat logs and moderation actions may be stored for up to 12 months to enforce the rules and protect the community.
The content of the server and website is generally suitable for a broad audience, including teenagers. Parents and guardians are responsible for supervising minors who use the service.
§ 7 Ingame Purchases, Store and Donations
Any paid content (e.g. ranks, cosmetics, crate keys, or direct donations) is offered as a voluntary contribution to the project. There is no claim to the permanent availability of purchased content. The operator provides virtual goods as a limited, non-transferable right of use for the duration of the account.
For consumers within the European Union: when purchasing digital content that is delivered immediately, the statutory 14-day right of withdrawal under the EU Consumer Rights Directive expires once the performance has begun, provided you have expressly agreed that performance begins before the withdrawal period expires and you acknowledge that you lose your right of withdrawal (§ 356 para. 5 BGB). This is confirmed during the checkout process.
Crate keys and virtual rewards are part of the in-game economy. Lost, traded, or deleted items are generally not restored. Chargebacks or payment reversals may result in the removal of purchased benefits and a permanent ban.
§ 8 Consumer Information and Cancellation Policy
For paid services offered directly to consumers (EU), the following applies: the operator is Patrick Guth (see imprint), the total price including taxes is shown before checkout, and the main characteristics of the virtual goods are described on the store page. The contract language is English.
Cancellation policy: you have the right to withdraw from the contract within 14 days without giving any reason. For digital content that has already been delivered and activated with your consent, the right expires as explained above. § 9 Liability
The operator is liable according to the statutory provisions for damages resulting from the violation of life, body or health, which are based on a negligent or intentional breach of duty, as well as for other damages resulting from an intentional or grossly negligent breach of duty. For slight negligence, the operator is only liable for damages only for a breach of a essential contractual obligation and limited to the typically foreseeable damage. For data loss, especially in-game progress, no liability is assumed, provided it is legally permissible.
§ 10 Rights to Content
The operator grants players a simple, non-transferable right to use the server within these conditions for the duration of use. All rights to the website, logo, design, blog articles and the provided content remain with the operator. Buildings created by players may be used for promotional purposes of the server in an anonymized form.
Third-party icons and graphical assets (e.g. from Flaticon) remain the property of their respective authors and are used under their applicable license terms. Custom feature images, graphics, and blog images are created specifically for test-web and may not be copied or reused without permission.
§ 11 Blog and Informational Content
The blog section of the website provides information about gameplay features, server events, and project updates. All blog content is for informational purposes only. The operator reserves the right to edit, update, or remove articles at any time. No guarantee is given for the completeness, accuracy, or timeliness of the information provided.
§ 12 Affiliate Links
Some links on this website, in particular the link to CloudExa-Hosting on the partners page and in the footer, are affiliate links. If you click such a link and purchase a service, test-web may receive a commission at no additional cost to you. The operator only recommends partners whose services are relevant to the project. The terms and pricing of the partner apply to any purchase.
§ 13 Changes to the Conditions
The operator reserves the right to amend these terms and conditions and the server rules at any time with effect for the future, particularly to implement changed legal requirements or to improve the game operation. The respective current version is available on this page.
§ 14 User Accounts
Visitors may register a free user account on the website. By registering, you agree to provide accurate information and to keep your login credentials confidential. You are responsible for all activities carried out under your account.
Accounts are intended for personal use only. The operator may suspend or delete accounts that violate these terms, attempt to circumvent rules, or are used to submit false applications or reports. There is no entitlement to a particular username or to permanent availability of the account.
§ 15 Staff Applications
Applying for a staff position requires a registered user account. Each user may submit only one application at a time and must wait 30 days before submitting another application (cooldown). Submitting multiple applications through alternative accounts or channels (including Discord) to bypass the cooldown is prohibited and may lead to disqualification and account sanctions.
The operator will review applications at its own discretion. Applicants will be informed of acceptance or rejection via the status page and, if accepted or rejected, by the staff note visible there. Please do not ask about the status of your application in tickets, in-game chat or Discord for at least 2 days after submission.
False or misleading information in an application may result in immediate rejection and further account restrictions.
§ 16 Minecraft Account Linking
You may voluntarily link your Minecraft account to your website profile. Linking requires entering your in-game username and completing the verification step in Minecraft. The linked UUID and username are displayed on your public profile and may unlock additional website features.
You can unlink your account at any time in the account settings. The operator is not responsible for data loss or ranking changes on the Minecraft server that may result from linking or unlinking. Linking does not transfer ownership of the Minecraft account or any in-game items to the website operator.
§ 17 Cookie Consent and Digital Services Act
This website uses only technically necessary cookies and local storage. Before any non-essential storage takes place, we request your consent via a clearly visible banner with equally prominent accept and reject options, as required by § 25 TDDDG and Art. 7 GDPR. You can withdraw or change your consent at any time via the "Cookie settings" option.
test-web complies with the Digital Services Act (DSA) and the German DDG. We do not use algorithmic recommendation systems or targeted advertising. Notices regarding illegal content can be sent to the email address listed in the imprint.
§ 18 Final Provisions
The law of the Federal Republic of Germany applies, excluding the UN Sales Convention. The court of jurisdiction is, where legally permissible, the domicile of the operator ([Schwedt/Oder]). If individual provisions of these terms and conditions are ineffective, the effectiveness of the remaining provisions remains unaffected.
test-web is an independent community project and has no connection to Mojang AB or Microsoft.
